According to TTCP, the FLC Legacy Kon Tum project was assigned by Kon Tum province to FLC Group with an area of ​​​​nearly 180,000 m2. On July 18, 2019, Kon Tum Provincial People’s Committee approved the auction winning result and issued a decision on the sale of public property to the only person who registered to buy. At the time of inspection (August 2020), FLC Group did not fulfill its financial obligations.

By September 16, 2020, FLC had just paid the total winning amount of 204 billion VND and the late payment fine was nearly 21 billion VND. According to TTCP, this is a violation of the regulations on asset auctions and property purchase and sale contracts, but the People’s Committee of Kon Tum province has been resolute and drastic in handling the cancellation of auction results.

Besides, while the investment project has not been completed, the provincial land registration office advises on granting certificates of land use rights, ownership of houses and other land-attached assets. Arbitrarily separating a land plot of more than 71,600 m2 into 474 plots and separately issuing certificates of land use rights, ownership of houses and other land-attached assets to FLC Group with a long term is not in accordance with regulations Law of the Land.

With the above violations, Kon Tum Provincial People’s Committee explained that this place is a particularly difficult area, attracting investment is not favorable. When there are big investors, the locality has created all conditions and repeatedly urged FLC Group to pay money. However, due to the outbreak of the Covid-19 epidemic, investors were affected and faced financial difficulties.

Construction before being approved for investment policy

In 2021, Quang Ninh Provincial Inspector also inspected 2 projects in Ha Long City invested by FLC Group, namely the Complex of Convention Center, service area, tourism resort and FLC resort villas. and the Ha Long Star Golf Course project at Column 3 to Column 8 in Ha Long City.

As a result, Quang Ninh Provincial Inspector discovered and pointed out a series of irreparable violations in the two projects above of FLC Group.

According to the Inspector of Quang Ninh province, on January 30, 2018, the Ha Long Star Golf Course project at Column 3 to Column 8 in Ha Long City was approved by the Prime Minister for investment policy and on February 5, 2018. 2018 has just been granted an investment registration certificate.

At the same time, on April 21, 2017, the new project of the Ministry of Natural Resources and Environment approved the Environmental Impact Assessment Report (EIA); On March 13, 2018 the People’s Committee of Quang Ninh province allocated land and on April 3, 2018, a new land lease contract was signed. However, since September 2016, the investor has started construction of the project.

With the above law violation, on February 28, 2017, the investor was administratively sanctioned by the Chairman of Quang Ninh Provincial People’s Committee for a violation of VND 400 million for not having an approved EIA.

Then, on January 18, 2019, the Chief Inspector of the Quang Ninh Department of Construction continued to impose a fine of 40 million VND for organizing the construction of technical infrastructure without a license.

Not only that, according to the conclusion of the Inspectorate of Quang Ninh province, the investor also uses the majority of the remaining 6.64 ha/95.52 ha according to the project’s planning (including the area under the project management plan). position of Cluster 42 – Command of Military Region 3) to build green trees, golf courses and temporary houses, when there is no decision on land lease, and the field land has not yet been handed over.

Unauthorized construction at 2 big projects

This agency also allows to change the purpose of using more than 11 hectares of protective forest land to implement the Sam Son FLC project when it has not yet met the conditions prescribed by the Government on the implementation of the Law on Forest Protection and Development.

Thanh Hoa province also did not issue a decision approving the 1/500 plan for this investor’s golf course and ecological urban area project in Quang Cu.

There are 2 works under FLC Sam Son project and 2 works under FLC Sam Son Golf Links project have been completed, but at the time of inspection, there was no construction permit.
