From January 1, 2022, according to the provisions of Decree 100/2019/ND-CP and Point B, Clause 4, Article 2 of Decree 123/2021/ND-CP supplement, the act of not wearing a helmet when participating in traffic will be penalized as follows:

– A fine of from 400 to 600 thousand VND for passengers who do not wear “helmets for motorcyclists and motorcyclists” or wear “helmets for motorcyclists and motorbikes” without properly fastening the straps when driving. driving vehicles participating in traffic on the road;

– A fine of from 400 to 600 thousand dong for passengers carrying people sitting on vehicles without wearing “helmets for motorcyclists and motorbikes” or wearing “helmets for motorcyclists and motorbikes” without proper straps specifications, except for transporting patients to the emergency room, children under 06 years of age, escorting people with illegal acts.

Previously, the fine under Decree 100/2019/ND-CP for not wearing a helmet when operating a motorbike was only fined from 200,000 to 300,000 VND.

How much is the fine for underage traffic?

According to the provisions of Point A, Clause 4, Article 21 of Decree 100/2019ND-CP, people from full 16 years old to under 18 years old driving motorbikes and mopeds with a cylinder capacity of 50 cm3 or more will be fined. from 400 to 600,000 VND.

Point D, Clause 5, Article 30 of Decree 100/2019/ND-CP stipulates a fine of between VND 800,000 and VND 2 million for individuals and from VND 1.6 to 4 million for organizations that are motor vehicle owners. cars, motorbikes and other vehicles similar to motorcycles when delivering the vehicle or letting a person who does not meet the conditions specified in Clause 1, Article 58 of the Law on Road Traffic operate the vehicle in traffic (including case the vehicle driver has a driving license but has expired).

Thus, according to regulations, in addition to underage drivers will be fined, car owners who hand over cars to underage drivers will also be administratively sanctioned.

Besides, if causing damage to property, damage to health and life of other people, they may be considered for criminal prosecution respectively for violations.
