In the long term, it is advisable to ban division of plots for sale and division of parcels

Many people question whether the ban on division of plots and parcels will reduce repeated land fever in stages. Although it is recognized that this solution is only a situation, it is difficult to completely prevent land fever, but experts say that, in the long run, it is advisable to ban division of plots and parcels.

In the face of widespread subdivision, affecting the real estate market, many provinces and cities have “tightened” the conditions for subdivision and plot separation in order to control land fever.

Recently, the Hanoi Department of Natural Resources and Environment has sent a document to the districts, towns, requesting inspection and reporting on the division of plots, division of land plots, leveling of land for infrastructure construction from January 1. /2017 to the end of January 31, 2022 for land plots with an area larger than 500m2, including: agricultural land, residential land and agricultural land in the same land parcel already granted by district-level People’s Committees certificate of land use right, permitting the change of land use purpose.

Previously, Dong Xoai city, Binh Phuoc province issued an urgent dispatch to suspend the separation of agricultural land plots and strengthen land management in the area.

Similarly, the People’s Committee of Khanh Hoa province also requested to strengthen the inspection and control of applications for change of purpose of households and individuals. The land is located outside the existing residential area, leading to the formation of new residential areas that do not meet the regional infrastructure conditions, causing widespread subdivision of plots for sale in the area.

In the past time, investors have flocked to buy small land and then self-divide plots to sell in some areas in the district that are preparing to move to the district – where land prices fluctuate greatly. However, if the investment is not based on the planning, it may lose everything when the area opens or develops public works, the risk is very high. Therefore, the move to tighten the subdivision and separate the parcels is a warning so that people do not have the mentality to collect and buy small land without paying attention to the planning.

According to Mr. Nguyen Van Dinh, Chairman of the Vietnam Real Estate Brokers Association, tightening the division of plots and parcels is only a temporary and short-term measure to control the situation, should not abuse administrative orders in house management. water with unmanageable thinking is forbidden. But in the long term, it is necessary in each locality to do well planning and land use plans with a long-term vision and then make it public for the people to know. The use of land for housing, industrial real estate, tourism, services, etc. needs to be included in long-term plans, plans, and methodical projects to create mainstream real estate products instead of real estate. “contraband.

According to Mr. Dinh, tightening regulations on division of plots and parcels like Hanoi and some localities are doing will reduce the bustling situation of buying and selling land in subdivisions and parcels. In the short term, this move will cool down speculators’ thirst for land.

According to experts, in the long run, it is necessary to strongly decentralize the local government to be responsible for project approval and take maximum responsibility for the management of subdivision and land sale projects. At the same time, it is necessary to strengthen the supervisory role of specialized management agencies. In particular, it is necessary to issue a general regulation with clear criteria that the subdivision and sale of land must be met. The level that approves and manages it is based on the issued criteria and the planning of each locality.

Sharing in the press, Professor Dang Hung Vo, former Deputy Minister of Natural Resources and Environment, said that in the long term, it is advisable to ban the division of plots and plots for sale. This method should only be used in some rural areas in need of residential land for households separated from one household, not market-oriented. Subdivision of plots for sale causes people to accumulate money in the land, leaving the land intact without building infrastructure or developing business. This only brings short-term economic benefits. In the long run, if this situation continues, there will be many consequences, depleting resources.

According to Prof. Vo, after the 2003 Land Law, there were regulations under the law that strictly prohibited the subdivision of plots for sale in urban areas, and urban planning development. But after a few years, the regulations were more open, allowing subdivision to sell plots in towns and rural areas. Until the Land Law 2013, it was allowed to subdivide plots for sale right in the city center. This is not reasonable, so the mechanism of dividing plots for sale must definitely be abandoned. Soil is first in the base soil, then in other types of soil.

Mr. Le Hoang Chau, Chairman of Ho Chi Minh City Real Estate Association, said that the Land Law 2003 and 2013 did not regulate the separation of agricultural land plots or the separation of other types of land other than residential land. The 2013 Land Law only stipulates the separation of residential land plots in rural areas and residential land parcels in urban areas. However, Decree 43 stipulates that the Provincial People’s Committee shall stipulate the minimum area allowed to separate the parcel for each type of land to suit the specific conditions of the locality. It can be understood that allowing the separation of plots for agricultural land, forestry land, non-agricultural land … which can lead to speculators taking advantage of widespread splitting and transforming it into residential land, causing destruction. urban development planning disruption. HOREA has proposed to the Government to consider and abolish this regulation because it is not in accordance with the Law of Land and may lead to an increase in the situation of widespread division and separation of parcels, which is difficult to control.

According to experts, the division of plots and plots often take place in a fragmented, spontaneous and unplanned manner, which easily leads to difficulties in the synchronous deployment of social infrastructure, so it is necessary to tighten it.
