Imported movies with content that violates the ban will have their licenses revoked

The Government has just issued Decree No. 22/2022/ND-CP dated March 25, 3022 amending and supplementing a number of articles of the Government’s Decree No. 32/2012/ND-CP dated April 12, 2012 on managing the export and import of cultural products for non-business purposes, in which some regulations on film import are added.

Specifically, the Decree supplements Clause 3, Article 8 with the authority to grant import permits for cultural products as follows: The film import licensing agency revokes the film import license when detecting that the film’s content violates the prohibited provisions in the Law. Film.

Regarding procedures for licensing import of cultural products, the Decree amends and supplements Clause 5, Article 9 as follows: Individuals and organizations are responsible for providing imported cultural products and customs declarations (a copy is not required). authentication) to the licensing agency to inspect.

For imported cultural products being films: The organization is responsible for providing the imported film copy and the customs declaration within 30 days from the date of obtaining the import permit for assessment.

The import licensing agency shall make a record of assessment and handover of the film based on the dossier and summary of the film’s content.

The Decree also adds provisions: Individuals who import movies for personal use only commits not to violate the prohibition provisions in the Law on Cinema and use films in accordance with the provisions of the law.

Additional time for licensing and assessment of cultural products that are films

In addition, the Decree also amends and supplements Clause 2, Article 10 of the license to import cultural products as follows: Within 2 working days from the date of receipt of a complete and valid dossier, the licensing authority shall license must be granted.

For cultural products being films, within 3 working days from the date of receipt of a complete and valid dossier, the licensing authority must issue a permit.

In addition, the Decree amending and supplementing Clause 5, Article 10: The maximum time for assessment of imported cultural products shall not exceed 12 working days. For film cultural products, the time for film assessment shall not exceed 12 working days from the date the organization provides the film copy.

Decree No. 22/2022/ND-CP takes effect from May 10, 2022.
